Terms of Use

These Terms of Use (“Terms”) govern access to and use of efour.com (the “Site”), operated by Efour (“Efour,” “we,” “us,” or “our”). By accessing the Site, you agree to these Terms. If you do not agree, do not use the Site.

These Terms govern use of the Site only. They do not govern the terms of any engagement, Statement of Work, or Master Services Agreement between Efour and a client, which are separately negotiated and executed.

1. Eligibility
The Site is intended for business professionals evaluating Efour’s engineering services. By using the Site, you represent that you have the authority to engage with us on behalf of your organization, where applicable.

2. Use of the Site
You may use the Site for lawful purposes related to evaluating or engaging Efour’s services. You agree not to:

  • Use the Site in any way that violates applicable law
  • Attempt to gain unauthorized access to Site systems, data, or networks
  • Interfere with or disrupt the Site’s operation, including through malware, scraping bots, or excessive automated requests
  • Reproduce, duplicate, copy, sell, or exploit any portion of the Site without written permission
  • Misrepresent your identity or affiliation when submitting forms or inquiries

3. Intellectual Property
All content on the Site — including text, graphics, logos, case studies, architecture diagrams, and the Efour name and brand marks — is owned by Efour or its licensors and protected by applicable intellectual property law. No license is granted to you except the limited right to view the Site for its intended purpose.

Client names, logos, and case study content referenced on the Site are used with permission and remain the property of their respective owners.

4. Submissions
Information you submit through contact forms, discovery call requests, or other Site channels is handled in accordance with our Privacy Policy. Any feedback, ideas, or suggestions you voluntarily submit to us may be used by Efour without obligation or compensation to you.

5. No Professional Advice
Content on the Site — including technical commentary, architecture perspectives, and industry analysis — is provided for informational purposes only. It does not constitute engineering, legal, financial, or professional advice specific to your organization’s circumstances. Any engagement-specific recommendations are governed by a separately executed Statement of Work.

6. Third-Party Links
The Site may link to third-party websites or resources. Efour does not control and is not responsible for the content, accuracy, or practices of any third-party site. Inclusion of a link does not imply endorsement.

7. Disclaimers
THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. EFOUR DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, EFOUR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. EFOUR’S TOTAL LIABILITY FOR ANY CLAIM ARISING FROM USE OF THE SITE SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD).

This limitation does not apply to liability arising under a separately executed Statement of Work or Master Services Agreement, which is governed by the liability terms in that agreement.

9. Indemnification
You agree to indemnify and hold Efour harmless from any claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles.

Any dispute arising from or relating to these Terms shall be resolved through binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, conducted in Delaware, with judgment on the award enforceable in any court of competent jurisdiction. Either party may bring an individual action in small claims court as an alternative to arbitration for disputes within that court’s jurisdiction. Disputes shall be resolved on an individual basis only; class actions and class arbitrations are not permitted under these Terms.

11. Changes to These Terms
We may revise these Terms at any time. Continued use of the Site after changes take effect constitutes acceptance of the revised Terms. Material changes will be reflected by an updated “Last Updated” date.

12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
